These Conditions of Use (“Terms”) govern your access to and use of the Brick & Beacon Marketing, LLC (“Brick & Beacon,” “we,” “us,” or “our”) website, including its pages, forms, calculators, resources, and other features (collectively, the “Site”).
1. Acceptance of These Terms
By accessing or using the Site, you agree to these Terms and our Privacy Policy. If you do not agree, please do not use the Site. If you use the Site on behalf of a business or other organization, you represent that you have authority to bind that organization to these Terms.
2. Website Information; No Client Relationship
The Site provides general information about our marketing services, educational resources, and ways to contact us. Site content is not legal, tax, accounting, financial, or other professional advice. Your use of the Site, submission of a form, request for a consultation, or other communication with us does not create a client, fiduciary, or confidential relationship.
Any services we provide are governed by a separate written agreement. If these Terms conflict with a signed client agreement, the signed client agreement controls for those services.

You must be at least 18 years old and legally capable of entering into a binding agreement to use the Site. Do not use the Site if applicable law prohibits you from doing so.

You are responsible for ensuring that information you submit is accurate, lawful, and does not infringe another person’s rights. Please do not submit confidential, proprietary, regulated, or sensitive information unless we have agreed in writing to receive it securely. You authorize us to use submitted information to respond to you, evaluate your request, provide requested services, and operate our business, subject to our Privacy Policy.
7. Calculators, Estimates, Case Studies, and Results
Calculators, projections, benchmarks, case studies, testimonials, examples, and other resources on the Site are provided for general informational and planning purposes only. They may rely on assumptions or third-party data, may not reflect current conditions, and do not guarantee actual performance, leads, revenue, reach, conversions, or other results. Your results will vary based on factors such as market conditions, budget, audience, offer, competition, creative, execution, and measurement methods.

12. Limitation of Liability
To the fullest extent permitted by law, Brick & Beacon and its owners, officers, employees, contractors, agents, and affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, goodwill, or business opportunities, arising from or related to the Site or these Terms, even if advised of the possibility of such damages.
To the fullest extent permitted by law, our aggregate liability for claims arising from or related to the Site or these Terms will not exceed $100. Some jurisdictions do not allow certain warranty exclusions or liability limitations, so some of the above may not apply to you.
13. Indemnification
To the extent permitted by law, you agree to defend, indemnify, and hold harmless Brick & Beacon and its owners, officers, employees, contractors, agents, and affiliates from claims, losses, liabilities, damages, judgments, costs, and reasonable attorneys’ fees arising from your unlawful misuse of the Site, your violation of these Terms, or your infringement of another person’s rights.
14. Suspension or Termination
We may restrict, suspend, or terminate access to the Site if we reasonably believe a user has violated these Terms, created risk or potential legal exposure, or interfered with the Site’s operation. Provisions that by their nature should survive termination will survive.
15. Governing Law and Venue
These Terms are governed by the laws of the State of New Hampshire, without regard to conflict-of-law principles. Subject to applicable law, any dispute arising from these Terms or the Site will be brought exclusively in the state or federal courts with jurisdiction in New Hampshire, and you consent to their personal jurisdiction.
16. Changes to These Terms
We may update these Terms from time to time. We will post the revised Terms on this page and update the “Last Updated” date. Changes become effective when posted unless otherwise stated. Your continued use of the Site after changes take effect constitutes acceptance of the revised Terms to the extent permitted by law.
17. General Terms
If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect. Our failure to enforce a provision is not a waiver. You may not assign your rights or obligations under these Terms without our written consent. These Terms, together with the policies referenced here, constitute the entire agreement between you and Brick & Beacon regarding use of the Site.
